These Terms & Conditions ("Terms") govern your access to and use of the website and services provided by Hostimus LLC, dba Launch Smarter ("Launch Smarter," "we," "us," or "our"). Launch Smarter provides data-driven marketing services including performance marketing, paid media management, campaign analytics, and brand strategy. Specific service terms, deliverables, and fees are set out in individual service agreements executed with each client. In the event of a conflict between these Terms and a signed service agreement, the service agreement controls.

3. SMS / Text Messaging Program Terms

By providing your mobile phone number and opting in, you agree to receive SMS messages from Launch Smarter. Participation in our SMS program is subject to the following terms:

  • Consent is voluntary and separate. Marketing and transactional SMS consent are collected as separate opt-ins and are never pre-checked or required to submit our contact form.
  • Message rates apply. Message and data rates may apply. Message frequency varies.
  • Opt-out. Reply STOP to any message to opt out at any time. Reply HELP for help.
  • Carrier responsibility. We are not responsible for delivery delays or failures caused by your mobile carrier.
  • Eligibility. You represent that you are the owner or authorized user of the mobile number provided and are at least 18 years of age.

4. Intellectual Property

5. Client Content and Accounts

Clients are responsible for the accuracy of content, assets, and access they provide for campaign management. You grant us a limited license to use such materials solely to provide the services agreed upon.

6. Disclaimers

Marketing results depend on many variables outside our control. We do not guarantee specific outcomes, including revenue, ROAS, or conversion results. Services are provided "as is" to the extent permitted by law.

7. Limitation of Liability

To the maximum extent permitted by law, Hostimus LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or services.

8. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles.
